Beloved comic Carol Burnett and her husband, Brian Miller are seeking to obtain legal guardianship of her 14-year-old grandson. Burnett and her husband filed a petition in Los Angeles County Superior Court asking that she be named her grandson's guardian, due to her daughter's drug addiction and substance abuse problems. Dylan Hamilton-West is the son of Burnett's daughter, Erin Hamilton, and her ex-husband, Tony West.

Erin is one of three daughters that Burnett had during her marriage to Joe Hamilton until they split in 1984. Burnett mentioned that due to the substance abuse issues that her daughter is currently battling, guardianship would be for "oversight purposes concerning his health, education and welfare." It also stated specifically it is not to deny the boy the right to see his parents, and that she hopes that recovery will be the next step in the process.

In court documents obtained by NBC, Burnett said that Erin has battled "severe substance abuse and addiction issues" for a good part of her adult life. She has been institutionalized eight times over the past 19 years and has been in and out of rehabilitation centers. She and Dylan's father were married for only four months before they divorced.

In the filing, it was also said that on July 15, Hamilton had sent text messages to her adult son, Zachary Carlson, as well as 14-year-old Dylan, threatening suicide. Dylan called his father, who in turn called the police, where a wellness check was conducted. Hamilton was held on a 51/50 hold for "suicidality and drug use." Hamilton was then taken to two different hospitals, where she was treated and eventually released on July 24.

Burnett and her husband also said that Dylan's father, Tony West is currently unable to provide care or financial support for his son, as he has recently checked into a rehabilitation facility himself. In the filing, Burnett and Miller also said, "Dylan’s living environment has long been unstable, unpredictable, and unhealthy for a child."

In both 2018 and 2019, The California Department of Children and Family Services conducted their own investigations into Dylan's living situation. Burnett can recall one time when Hamilton was in a rehabilitation facility that she took Dylan to Lake Arrowhead. Burnett mentioned that he began to cry and begged her not to take him home to his father.

However, West was given full physical custody of Dylan in November 2019. His mother was only allowed to see him during monitored visits. During the beginning of the pandemic, he was living with his father until he checked into a rehab facility because of his addiction to drugs. After his father left for the rehabilitation center, Dylan went to live with a friend in Ojai, California.

A hearing for the petition for guardianship is scheduled for January 8, 2021.
